The petitioner is in custody in connection with Govindpur P.S.Case No.105 of 2016 registered for an offence under Sections 30(a) of the Bihar Prohibition & Excise Act. The informant happens to be the police officer who after getting information intercepted few vehicles. This petitioner was found driving of a Bolero pick up van and on search 48 cartoons containing litres wine and several other miscellaneous articles were recovered.
Contention of the learned counsel for the petitioner is that he had no knowledge about the articles which were loaded in the said vehicle. He is simply a driver and has no concern with any of the articles which were recovered from the vehicle. The petitioner is in custody since 13.11.2016
Patna High Court Cr.Misc. No.5586 of 2017 (2) dt.07-02-2017 Under the aforesaid facts and circumstances prayer for bail is allowed and the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Nawada in connection with Govindpur P.S.Case No.105 of 2016.
