ANJANA MISHRA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner seeks modification of order dated 12.01.2016 passed in Cr. Misc. No. 32833 of 2015. It is submitted by learned counsel for the petitioner that since the petitioner is a daily wager and is functioning as a Computer Operator, the amount fixed in the order could not be arranged and, therefore, he seeks modification of the period fixed for surrender in the order and also prays that amount, in question, may be reduced so that he may be able to file his bail bonds after depositing the amount. It is further submitted that the petitioner is willing to deposit Rs. 40,000/- (Forty thousand) for the present and easy installment may be fixed in the amount of rupees two lacs and that the time for surrender may be further extended. Considering the genuine difficulty expressed by the
Patna High Court Cr.Misc. No.8681 of 2016 (2) dt.16-03-2016 P2/2 petitioner, let the petitioner deposit a sum of Rs. 50, 000/-(rupees fifty thousand) within a period of three weeks from the date of receipt/production of a copy of this order in the Court below. It is further directed that if the petitioner deposit the aforesaid amount, the order dated 12.01.2016, shall stand modified and in the event of his arrest or surrender within three weeks thereafter the petitioner shall be released on bail. It is further directed that the rest amount of Rs. 1,50,000/- shall be paid in equal installments by the petitioner within a period of six months. In case, the same is not done, the petitioner shall render himself liable for cancellation of bail.
