Petitioner apprehends his arrest in a case under sections 364, 302, 34 of Indian Penal Code.

Informant alleged that on 23.07.2011, his son Manjit Kumar, aged 10 years, was found missing from the door of his house. On search, the dead body of his son was found from nearby place of his house. The informant submits that on account of land disputes, the accused persons had earlier threatened him with dire consequences.

Learned counsel for the petitioner submits that at best there is suspicion against him. No one has seen him taking away the informant's son.

Patna High Court Cr.Misc. No.8542 of 2016 (3) dt.12-04-2016 2/2 Learned counsel for the State submits that the occurrence is of the year 2011 and the petitioner has filed anticipatory bail application in the year 2016. In view of nature of allegations and also that the petitioner has belatedly filed his anticipatory bail application in the year 2016, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is refused with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice, preferably on the same day.
