This application is for grant of bail in connection with Bishambharpur P.S.Case No.14 of 2017 for the offence under Sections 272, 273 and 420/34 of the Indian Penal Code. It is submitted on behalf of the petitioners that the allegation against the petitioners are that while a four Wheeler Vehicle was intercepted, some accused persons fled away and the petitioners were arrested. On search, 121 ltrs. of liquor (foreign and countrymade) were recovered from the said vehicle. It is also submitted on behalf of the petitioner that they have been falsely implicated in this case. The petitioner no.1 has clean antecedent and the petitioner no.2 is accused in one case. They are in custody for
Patna High Court Cr.Misc. No.13106 of 2017 (3) dt.10-04-2017 about two months.
Heard learned A.P.P. also.
Having heard both sides and in view of the seizure of liquor and its quantity, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail before the court concerned either after framing of the charge or three months.
With the aforesaid observation, this application is dismissed.
