JUSTICE SANDEEP KUMAR ORAL ORDER 25-04-2024 This application has been filed for setting aside the dated 24.02.2023 contained in memo no. 1063/Arms of the District Magistrate, Patna whereby and where under the petitioner's Arms license for DBBL gun and .22 bore license has been suspended in contravention of sections 3 and 17 of the arms act 1959.

2. From reading the impugned order dated 24.12.2023, it appears that the District Magistrate, Patna has not

Patna High Court CWJC No.3799 of 2024(3) dt.25-04-2024 2/2 considered the show cause submitted by the petitioner and by a cryptic and non-speaking order, the impugned order has been passed.

3. The impugned order dated 24.12.2023 is no order in the eye of law.

4. In view of the above, this application is allowed and the impugned order dated 24.02.2023 contained in memo no. 1063/Arms of the District Magistrate, Patna is hereby quashed.

5. The matter is remitted back to the District Magistrate, Patna for passing a fresh order in accordance with law after considering the show cause of the petitioner and after hearing the petitioner.

6. With the aforesaid observation and direction, this application is allowed.
