The Petitioner seeks bail in Kurtha P.S. Case No. 152 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, IVth, Arwal instituted for the offence under Section(s) 498A, 364/34 of the Indian Penal Code. The petitioner is husband of the deceased.

As per prosecution case, the deceased was married with this petitioner in the year 2011 and thereafter she was tortured for demand of dowry and ultimately done to death in her matrimonial home. This petitioner informed to the informant on phone that his daughter has fled away from matrimonial home. The informant went to the matrimonial home of his daughter and

Patna High Court Cr.Misc. No.3739 of 2017 (4) dt.07-03-2017 2/2 found the house locked. The informant with the help of the police unlocked the house and found nobody present in the house. Learned A.P.P. has submitted that witnesses in the case diary have supported the case and levelled allegation against this petitioner.

In such circumstance, this Court is not inclined to grant bail to the petitioner. Accordingly the prayer for bail of the petitioner stands rejected.

Learned Court below is directed to expedite the trial.
