Mr.Sharda Kumari,APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 06-05-2019 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
According to FIR, the petitioner and three others assaulted to the husband of the informant with sword, dagger etc., as a result whereof, husband of the informant died due to profuse bleeding. The Doctor has found five incised wound on the person of the informant, most of them are on vital part of the body.
Submission is that allegation is not specific. Co-
Patna High Court CR. MISC. No.11351 of 2019(3) dt.06-05-2019 2/2 accused-Pappu Manjhi @ Pappu Paswan has already been allowed bail by a Coordinate Bench of this Court vide Annexure-2.
The order granting bail to co-accused-Pappu Manjhi @ Pappu Paswan reveals that the postmortem report was not brought to the notice of the Hon'ble Bench. Considering the material against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Shikarpur P.S.Case No.228 of 2018 pending in the court of learned Chief Judicial Magistrate, Bettiah, West Champaran. Hence, prayer is refused.
However, if the trial does not take any progress within six months, the petitioner would be at liberty to renew the prayer before the learned court below itself. (Birendra Kumar, J) Nitesh/- U T
