The petitioner has preferred this application for grant of regular bail in a case registered under sections 354B and 34 of the Indian Penal Code and sections 8 and 12 of the POCSO Act.

As per the prosecution case lodged by the minor informant, it is stated that the two accused persons including the petitioner herein came to her house, got her to open the door and started saying that they were love with her. It is stated that they misbehaved with her and on hulla being raised, neighbours and co-villagers came. While one of the accused was caught, the petitioner escaped.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and incorrect.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the petitioner having remained in custody for over 8 months, the petitioner is directed to be enlarged on bail in connection with Special Case no. 252 of 2019 (arising out of Gaurichak P.S. Case no. 488 of 2019) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge VII, POCSO Court, Patna.
