JUSTICE PRABHAT KUMAR JHA ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State through Video Conferencing.

The petitioner seeks bail in Inarwa P.S. Case No.16 of 2019 registered under Sections 341, 323, 324, 379, 498A and 34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.

The petitioner is alleged to have assaulted his wife with fist and slab due to non-fulfillment of demand of dowry. The learned counsel for the petitioner submits that petitioner never assaulted his wife. The wife of the petitioner is quarrelsome lady and she does not want to live with him.

No.16302 of 2020(2) dt.02-06-2020 2/2 On the other hand, Ms. Pronoti Singh, learned A.P.P. as well as Mr. Umesh Chandra Verma, learned counsel for the informant vehemently opposed the prayer for bail. It appears that petitioner is husband and he assaulted his wife due to non-fulfillment of demand of dowry but for that petitioner is in jail since 10.08.2019. Petitioner has already remained in jail for about ten months.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bettiah, West Champaran in connection with Inarwa P.S. Case No.16 of 2019.
