The petitioners are accused in connection with Special Case No. 171 of 2019 arising out of Kadamkuan P.S. Case No. 768 of 2019 registered under Sections 20 and 22 of the N.D.P.S. Act.
The accusation is of recovery of 6 Gram Smack each from possession of both petitioners.
Learned counsel for the petitioners submits that petitioners have no criminal antecedent and are in custody since 29.11.2019. Further submission is that the seized quantity of Smack from possession of the petitioners is only 1 Gram excess
Patna High Court CR. MISC. No.10213 of 2020(2) dt.03-03-2020 2/2 to the small quantity.
Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, N.D.P.S. Act/ Sessions Judge, Patna, in connection with Special Case No. 171 of 2019 arising out of Kadamkuan P.S. Case No. 768 of 2019.
