JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 143/353/504/506 of the Indian Penal Code.

It is alleged that one Kamlesh Kumar was killed and the petitioner along with other co-accused persons obstructing the informant in preparing the inquest report of dead body of deceased as they were demanding compensation. It is submitted by learned counsel for the petitioner that the accusation is general and omnibus and for the occurrence of 27.08.2014, the F.I.R. was registered on 30.08.2014 and it reached to the learned court below on 10.09.2014 which suggests antedating of the F.I.R. It is further submitted that 8 F.I.R. named co-accused persons have already granted anticipatory bail by this

Patna High Court Cr.Misc. No.15893 of 2015 (2) dt.16-04-2015 2/2 Court vide Criminal Miscellaneous No.14354 of 2015. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Taraiya P.S. Case No.114 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
