JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is accused in connection with Nautan P.S. Case No.12/17 registered under Sections 272, 273, 308, 34 of the Indian Penal Code and 30, 38 of Bihar Excise Prohibition Amendment Act.
In course of checking of the vehicles two persons were seen on motorcycle with gunny bag. On giving the signal to stop the motorcycle the person who was driving the motorcycle anyhow managed to escape but another person who was sitting on the motorcycle with bag fell down who disclosed his name as Chandan Kumar and also disclosed the name of his associate as Nagar tiwary. On search of bag 135 bottles each containing 200 ml
Patna High Court Cr.Misc. No.14264 of 2017 (2) dt.08-04-2017 2/2 country made liquor recovered.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case . The petitioner has no criminal antecedent and is in custody since 18.01.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XII, Siwan, in connection with Nautan P.S.Case No.12/17.
