The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 37(b)(c) of Bihar Prohibition and Excise Act.

700 ml. of foreign liquor has been recovered from the possession of two co-accused persons, who disclosed the name of petitioner, as their associate, who fled away after seeing the police.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from an open place behind Ara Machine and petitioner has been made accused only on the basis of disclosure made by co-accused. Petitioner has got clean antecedent.

Case No. 474 of 2021 (Special Case No. 8716 of 2021), subject to conditions as laid down under Section 438(2) of the Cr.P.C.
