2. The petitioner apprehends arrest in connection with Complaint Case No. 300 of 2021 (Tr. No. 1171/2023) registered for the offences under Sections 364, 302, 201, 120(B) of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the FIR has been lodged after two years. It is submitted that the alleged occurrence took place due to admitted land dispute between both the parties. It is further submitted that during entire course of investigation the police did not find any material against the petitioner and other

Patna High Court CR. MISC. No.14358 of 2024(2) dt.18-03-2024 2/2 co-accused persons. Hence, the police has submitted the final form against the petitioner which is contained in Annexure 'P/4' to the application. Petitioner has no criminal antecedent.

4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of learned 1st A.C.J.M., Bagha, West Champaran in connection with Complaint Case No. 300 of 2021 (Tr. No. 1171/2023) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

5. This application stands allowed.
