2. The petitioner seeks regular bail in connection with Turkauliya P.S. Case No. 569/2023 registered for the offences under Sections 302, 201, 120 (B) and 34 of the I.P.C. and Section 27 of Arms Act.

3. The prosecution case in nutshell is that one Vishwajit Kumar (co-accused) had taken away the son of the informant on pretext of marriage ceremony but later his son did not return and subsequently was found dead.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this

Learned counsel further submits that he was neither named by the informant in the FIR nor his name was taken by informant in his restatement. There was only a suspicion raised that the petitioner was along with the accused Vishwajeet Kumar. It is lastly submitted that the petitioner has four criminal antecedents and he is languishing in custody since 08.07.2024.

5. Learned counsel for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and taking into account the fact that the co-accused Vishnu Kumar who had taken the name of the petitioner in his confessional statement has been enlarged on bail by a Co-ordinate Bench of this Court vide order dated 07.04.2025 passed in Cr. Misc. No. 79898 of 2024, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran in
