2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 127(2), 115(2), 118(1), 109, 308(3) and 3(5) of the BNS.
3. Allegation against the petitioner and other coaccused persons is to have assaulted the informant and causing fire arm injury.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that similarly situated co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No.11516 of 2025 and the allegation is general and
Patna High Court CR. MISC. No.13774 of 2025(2) dt.28-03-2025 2/2 omnibus in nature and he has got clean antecedent as stated in para-3 of the petition.
5. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner.
6. In view of the aforesaid facts as well as the fact that similarly situated co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court as also the petitioner has got clean antecedent, so I am inclined to grant anticipatory bail to the petitioner.
7. Accordingly, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Pupri, Sitamarhi in connection with Nanpur P.S. Case No. 587 of 2024, subject to the conditions as laid down under Section 482(2) of the B.NS.S (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
