The petitioner is accused in connection with Ara Nawada P.S. Case No. 559 of 2016, registered under Section 25(1-B)a, 26 and 35 of the Arms Act.
The accusation is that on receiving information regarding gathering of culprits in Jain College Campus for committing crime, the Police reached at the spot. On seeing the Police personnel, three persons started fleeing, but one person was apprehended near the house of Dwarika Tiwari, the apprehended person disclosed his name as Manish Kumar. On search, one pistol containing magazine having two live cartridges recovered from his possession. He also disclosed the
Patna High Court Cr.Misc. No.13392 of 2017 (2) dt.23-03-2017 2/2 name of the petitioner and one Satyebans Singh as his associates, who succeeded to flee away.
Learned counsel for the petitioner submits that the petitioner has not been apprehended on the spot and his name has been disclosed by co-accused. Further submission is that petitioner is accused in three other cases, but he is on bail in all cases and in the present case, he is in custody since 04.11.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur Ara in connection with Ara Nawada P.S. Case No. 559 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
