====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 379, 504, 506 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R. named accused persons including these petitioners assaulted the informant and his family members. It is further alleged that petitioner Nos. 2 and 3 assaulted the father of the informant. Doctor has found the injury to be grievous in nature. Petitioner No. 1 is a lady and claims clean antecedent.

4. In view of the fact that petitioner Nos. 2 and 3 caused grievous injury, prayer for anticipatory bail of petitioner Nos. 2 and 3 is refused. However, considering the nature of accusation and clean antecedent against petitioner No. 1, the anticipatory bail with regard to petitioner No. 1 is allowed and it is ordered that the above named petitioner No. 1 in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1st, Naugachia, Bhagalpur in connection with Bihpur (Jhandapur) P. S. Case No. 680 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
