JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-03-2019 This is an application for grant of anticipatory bail in connection with Behiya P.S. Case No. 272 of 2018, disclosing offences under Section 366(A) of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that as a matter of fact, the petitioner was in love affair with the daughter of the informant and they have married also and living together and further the girl is major, which will appear from Annexure-2.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that the girl is still traceless, which will appear from the impugned order. Having heard both sides, in view of the facts and

No.13299 of 2019(2) dt.05-03-2019 2/2 circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, however if the petitioner surrender along with girl and the statement of girl has been recorded, the same shall be considered by the learned court below while considering the prayer for bail of the petitioner and will pass an appropriate order.
