JUSTICE SANDEEP KUMAR ORAL ORDER 31-03-2022 At the very outset, learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application as against Petitioner No. 3 and Petitioner No. 4. Permitted to be withdrawn.

It is, thus, dismissed as withdrawn as against Petitioner No. 3 and Petitioner No. 4.

Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Patna High Court CR. MISC. No.12527 of 2022(2) dt.31-03-2022 2/2 The petitioners apprehend their arrest in connection with Sathi P.S. Case No. 242/2021 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Five litres of illicit liquor has been recovered from the bush. Petitioner No. 1 and Petitioner No. 2 have been named along with others. They have clean antecedents. Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the Petitioner No. 1 and Petitioner No. 2. above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, West Champaran, Bettiah, in connection with Sathi P.S. Case No. 242/2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
