JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Nokha P.S. Case No. 184 of 2016, registered under Sections 147, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code. The accusation is that five persons named in the F.I.R., including the petitioners, came at the field of the informant and started assaulting to him. On raising alarm, when father, uncle and niece of the informant rushed to save the informant then they were also assaulted by the accused persons. Learned counsel for the petitioners submits that, in fact, the occurrence of Marpit took place due to land dispute in

Patna High Court Cr.Misc. No.13432 of 2017 (2) dt.24-03-2017 2/2 which petitioner side also sustained injury regarding which Nokha P.S. Case No. 183 of 2016, under Section 147, 149, 323 and 307 of the I.P.C. was instituted on the basis of the written report of Vishwanath Sahu father of the petitioners. Further submission is that petitioners are in custody since 09.01.2017. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-V, Rohtas at Sasaram in connection with Nokha P.S. Case No. 184 of 2016.
