The petitioner seeks bail in Magadh Medical P.S. Case No. 35 of 2020, registered for the offence punishable under Section 394 of the Indian Penal Code.

Earlier the bail application of petitioner was rejected vide order dated 05.11.2020. Vide order dated 14.07.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'R'), which reveals that two witnesses have already been examined and case is fixed for evidence.

Considering the nature of allegation and stage of trial, I am not inclined to enlarge the petitioner above-named on bail.

However, as the petitioner is in custody since 17.02.2020, trial court is directed to expedite the trial. (Prabhat Kumar Singh, J) vinita/- U T
