JUSTICE SATYAVRAT VERMA ORAL ORDER 12-09-2022 The learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.3 Jaykrishan Manjhi @ Jay Krishna Kr. Manjhi.

Permission is accorded.

Heard learned counsel for the rest petitioners and learned APP for the State.

The petitioner nos.1, 2 and 4 seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 354 and 504 of the

Patna High Court CR. MISC. No.12108 of 2022(2) dt.12-09-2022 2/3 Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 13.09.2021, the accused persons including the petitioner armed variously came at her house and assaulted the informant and petitioner no.3 assaulted the informant with rod causing injury on his nose and she became unconscious. Thereafter, petitioner no.2 assaulted informant's brother-in-law with an iron rod causing injury on his head and shoulder and Chanchal Manjhi (petitioner no.4) slammed informant's niece on the ground and assaulted her. The learned counsel submits that no reason for the occurrence is alleged in the F.I.R. It is next submitted that on account of land dispute, the present occurrence took place and the informant and the petitioners are agnates and thus, related. It is also submitted that one of the injuries caused to the informant was grievous, but the same was not caused by these petitioners and as far as other injuries suffered by the injured is alleged, the same is simple in nature.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioner nos.1, 2 and 4, above-

No.12108 of 2022(2) dt.12-09-2022 3/3 named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Bounsi P. S. Case No.203 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
