The petitioner seeks bail in a case under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The wife of the deceased named four persons and alleged that it was the petitioner who fired shot which hit her husband and her husband died.

Submission is that no charring mark was found although it is alleged that petitioner fired from a close range. The petitioner has falsely been implicated in this case as daughter of the petitioner is married to son of Brahmdeo Mandal. It appears that there is specific allegation against the petitioner that shot which he fired caused the death of husband of informant, I am not inclined to enlarge the petitioner on bail. The

Patna High Court Cr.Misc. No.12498 of 2015 (2) dt.07-07-2015 2/2 same is rejected.

However, the trial court is directed to expedite the trial and conclude the same within one year from the date of receipt / production of this order.
