JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned Senior counsel representing the informant. This application, for grant of anticipatory bail, arises out of Phulwarisharif (Janipur) P.S. Case No.816 of 2015, disclosing offences under Sections 448, 386, 379, 506 and 504/34 of the Indian Penal Code.
Allegation against the petitioner is that he caused obstruction in construction work of the informant's house and demanded a sum of Rs.1,00,000/- as Rangdari,
Patna High Court Cr.Misc. No.7901 of 2016 (4) dt.18-04-2016 2/3 to allow him such construction.
The petitioner, namely, Ravi Kant Sharma, is personally present in Court, in the light of order, dated 11.04.2016.
Learned counsel for the petitioner has submitted that the petitioner and the informant have common ancestors and out of land dispute, the present First Information Report has been instituted. A supplementary affidavit has been filed on behalf of the petitioner, wherein, it has been stated that he never caused any obstruction in said construction work nor will he ever cause any obstruction in future. Considering the facts and circumstances in entirety, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Phulwarisharif (Janipur) P.S. Case No.816 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the
Patna High Court Cr.Misc. No.7901 of 2016 (4) dt.18-04-2016 3/3 petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
