(i) For issuance of a writ/writs or order/orders in the nature of mandamus restraining the respondents from making any further illegal construction or temporary construction or constructing cemented road (Tented Houses or make shift camp) over the Plot No. 19 and 20, Rakba-32 acre situated at the northward side of Quilla House in view of the same

Patna High Court CWJC No.19654 of 2016(2) dt.07-04-2023 2/2 being subject matter of Title Quilla House in view of the same being subject matter of Title Suit No. 140 of 1995 pending before the Civil Court of Patna, wherein interim injunction is operating in favour of petitioner."

At the outset, the learned counsel for the petitioner submits that the learned trial court has already rendered judgment and decree in Title Suit No. 140 of 1995, filed by the petitioner before the learned court of Sub-Judge-VI, Patna City, and thereafter, the petitioner has also filed an Execution Petition, before the learned Executing Court for execution of the judgment and decree in question, hence the petitioner be granted liberty to prosecute the same. Liberty so sought is granted. The writ petition stands disposed off as not pressed.
