Perused the impugned order dated 05.11.2016 passed by Subordinate Judge, Benipatti in Title Eviction Suit No.01 of 2014 whereby the learned court below has allowed the amendment application filed by the plaintiff-respondent. At the time of hearing of this civil miscellaneous application the learned counsel Mr. Ramesh Kumar Choudhary for the petitioner admitted the fact that still issues have not been framed in the suit. Therefore, it appears that the amendment sought for is a pre-trial amendment.

Thus, I find no reason to interfere with the impugned order as there is no jurisdictional error. Accordingly, this civil miscellaneous application is dismissed.
