Petitioner seeks bail in connection with Pandaul P.S. Case No. 153 of 2016, G.R. No. 1488 of 2016 registered for the offences under Sections- 302/34 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is not named in the first information report. He has been implicated in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has been made accused on basis of confessional statement of co-accused. Similarly situated co-accused has been granted bail by this Court vide order dated 05.05.2017 passed in

Patna High Court Cr.Misc. No.16196 of 2017 (3) dt.15-05-2017 2/2 Cr. Misc. No. 17830 of 2017. Petitioner is in custody since 20.11.2016.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 153 of 2016.
