JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned senior counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Araria P.S. Case No. 97 of 2014 for the offences instituted under Sections 406, 417, 418, 420, 421, 424, 465, 468, 201 and 120(B) of the IPC.

The prosecution story, in brief, is that the accused persons were running a Finance Company, named Apana Parivar Agro Farm Developers India Ltd., and its Branch was opened also at Araria. The informant and some others on being persuaded by the petitioner and others opened their accounts in the said Finance Company who were later on appointed as collection agents on

Patna High Court Cr.Misc. No.8673 of 2016 (3) dt.18-04-2016 2/3 commission basis. Several customers were convinced to open their accounts in daily deposit and fixed deposit schemes. In this way, an amount of Rs. 1,51,43,421/- was deposited but at the stage of maturity of deposits, the office of the Company was closed and the accused persons left the place with all the records of the Branch. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is alleged to be the employee of the Finance Company working as an agent. It is further submitted that the petitioner is ready to deposit an amount of Rs. 40,000/- in the court below which shall be subject to final disposal of the case. The other co-accused have been granted anticipatory bail by this Court vide Cr. Misc. Nos. 35660/2014, 3410/2015 and 2855/2015.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs. 40,000/- in the court below which shall be subject to final disposal of the case and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Araria P.S. Case No. 97/2014, G.R. No. 623/2014, on furnishing bail

Patna High Court Cr.Misc. No.8673 of 2016 (3) dt.18-04-2016 3/3 bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
