The petitioner apprehends his arrest in connection with Kundwa Chainpur P.S. Case No.25 of 1997 registered under Sections 452, 380, 307, 342 and 324/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. as on the basis of the written report of the informant, the present case lodged against Noor Mohammad, Jitendra Srivastava and Sarfuddin along with 4-5 unknown. In course of investigation, only suspicion has been raised against the petitioner having his hand in the commission of the alleged offence in the supervision note of the SDPO. The

No.11385 of 2019(3) dt.17-05-2019 2/2 informant and the petitioner are co-villagers but in spite of that, the informant has not named the petitioner in the F.I.R. but, later on, the petitioner has falsely been made accused in this case. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Sikrahana at Dhaka, East Champaran, Motihari, in connection with Kundwa Chainpur P.S. Case No.25 of 1997, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U
