2. The present petition has been preferred for the following relief/s:

(i) for issuance of the nature of mandamus for direction to respondents to for fixation of the rent of the dispute land which has been settled by the title suit no. 62/2004 by the court of Munsif-IInd, Bhagalpur by judgment dated 14.01.2009 and further issue direction to the respondent authority to

Patna High Court CWJC No.19322 of 2016(2) dt.21-08-2025 2/2 consider the application of the petitioner in the light of the judgment and decree passed in title suit no. 62/2004 and further give other legal consequential benefits to the petitioner.

3. The matter is pending for long nine years without any counter affidavit.

4. This Court has two options, either to impose cost while allowing adjournment, alternatively, to direct the Collector, Bhagalpur (respondent no.3) to look into the matter and pass necessary order as the title suit has been decided in favour of the petitioner ex-parte in Title Suit No. 862 of 2004 (Sachchida Nand Jha vs. the State of Bihar).

5. The petitioner shall be filing an appropriate petition in next four weeks and the Collector, Bhagalpur after hearing the parties shall take the matter to its logical conclusion by 31.01.2026.

6. The writ petition stands disposed of.
