2. This is the 2nd attempt of the petitioners. Earlier the bail application of the petitioners was rejected vide order dated 22.02.2024 passed in Cr. Misc. No. 8740 of 2024 .

3. The petitioners seek regular bail in a case registered for the offence under Section 395 of the Indian Penal Code.

4. The following order was passed on 22.02.2024 in Cr. Misc. No. 8740 of 2024:- Heard learned counsel for the petitioners and learned APP for the State.

2. This application for grant of regular bail arises out of Phulwarisharif P.S. Case No.1380 of 2022 registered for the offence punishable under Section 395 of the Indian Penal Code.

3. The petitioners are said to have

Patna High Court CR. MISC. No.23118 of 2025(3) dt.11-07-2025 2/2 committed dacoity.

4. The petitioner is accused in six more cases of dacoity.

5. Considering the criminal antecedents of the petitioners, I am not inclined to grant the petitioner privilege of regular bail.

6. Accordingly, this bail application is rejected. The trail court is directed to expedite the trial and conclude the same as early as possible.

5. In the trial two witnesses have been examined, thereafter the trial was held up because of the non-appearance of the bailed out accused.

6. In these circumstances, this application for regular bail is dismissed with a direction to the Senior Superintendent of Police, Patna that he should ensure the appearance of the bailed out accused persons in the court below so that the trial proceeds.

7. Let a copy of this order be communicated to the Senior Superintendent of Police, Patna through FAX for its compliance forthwith.
