JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Dumariya P.S. Case no.65/12 registered under Sections 307/34/120 (B) of I.P.C. and Sections 25(1-b)A, 26, 27 and 35 of Arms Act. Learned counsel for the petitioner submits that it would appear from the F.I.R. itself that the name of the petitioner along with two others has surfaced on the basis of confessional statement of co-accused Mithun Bharti who was apprehended by the police on the spot. Further submission is that petitioner is in custody in present case since 4.12.2016 while he is also accused in two cases but is on bail in both the cases.

Having regard to the facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court Cr.Misc. No.12260 of 2017 (3) dt.06-04-2017 2/2 furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sherghati at Gaya, in Dumariya P.S.Case No.65/12.
