For the Petitioner/s :
Mr. Siya Ram Shahi Mr. Om Prakash Maharaj For the Respondent/s :
Mr. Mahendra Prasad Verma, AC to SC 20 ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 11-04-2019 Heard learned Counsel for the petitioners and the learned Counsel for the State.
The petitioners, who are aggrieved by non consideration of their claim for regularisation on Class IV posts in the district of Sheikhpura, assert that they were being coerced into giving an undertaking that they will not claim regularisation.
The assertion made by the petitioners seems insignificant in view of the fact that in paragraph 7 and 8 of the counter affidavit filed by respondent Nos. 2 to 11 specific stand has been taken that the authority are awaiting direction from the General Administrative Department in the matter of petitioners' regularisation. They have further gone to state that the respondent authorities are in process for appointment/ regularisation of the petitioners subject to their eligibility for the post of Class IV employee.
The stand of the respondent authorities is such that no
Patna High Court CWJC No.3247 of 2016(5) dt.11-04-2019 3/3 further direction is required to be issued in the instant proceeding.
The writ proceedings are therefore disposed.
The authorities would be obliged to carry forward the issue by taking action pursuant to the averments made in the counter affidavit.
