This is repeat application seeking bail. Earlier, his prayer for bail was considered and rejected vide order dated 10.11.2016 (Annexure-1) considering the allegation as well as the criminal antecedents.
It is submitted on the confession of the co-accused Mojib, the petitioner has been made an accused. Aforesaid co-accused Mojib has been granted bail vide order at Annexure-3. The petitioner is in custody since 03.08.2016.
Mr. Dayal, learned APP, on the other hand, points out that the petitioner is accused of series of criminal cases. He was also found sleeping with the co-accused Mojib when the recovery was made.
Patna High Court Cr.Misc. No.17750 of 2017 (2) dt.12-04-2017 2/2 Considering the facts and circumstances of the case, I am not persuaded to direct his release. Prayer is accordingly rejected. The trial court shall take steps for expeditious disposal of the case. In case all the witnesses on behalf of the prosecution are not examined within six months, the petitioner shall have liberty to renew his prayer for bail.
