JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-03-2016 It is stated by learned counsel, appearing on behalf of the petitioners, that petitioner No.2, namely, Matlub Ansari @ Mutalib Ansari, has been arrested by the police during the pendency of this application, in connection with Hussainganj P.S. Case No.55 of 2015. This application to the extent it relates to
petitioner No.2 stands dismissed as having become infructuous.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Hussainganj P.S. Case No.55 of 2015, disclosing offences under Sections 147, 148, 149, 323, 337, 427 and 307 of the Indian Penal Code.
Learned counsel for the petitioners, at the very outset, has drawn my attention towards an order, dated 13.08.2015, passed in Cr. Misc. No.32352 of 2015, whereby, similarly circumstanced co-accused persons have been granted the privilege of anticipatory bail. Considering the submission, as above, this application is allowed. Let the petitioner Nos.1, 3 and 4, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No.55 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the
petitioner Nos.1, 3 and 4 shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
