The petitioner apprehends his arrest in connection with Bayasi P.S. Case No. 201/2021 registered for the offences punishable under Sections 30(a)/41/47 of the Bihar Prohibition and Excise Act and Section 272/273/414 of the Indian Penal Code.

The petitioner is the owner of the Scorpio vehicle which was caught carrying 504 litres of illicit liquor. It has been submitted by learned counsel for the petitioner that the petitioner had sent the vehicle to Kolkata along with his sister and while coming back from Kolkata, the vehicle was used for transport of liquor by the driver without

Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Purnea, in connection with Bayasi P.S. Case No. 201/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
