This is an application for bail in connection with G.R.P./ Kiul P.S.Case No. 246 of 2016 registered for the offences punishable under Sections 30(A) and 38(i) of the Bihar Prohibition and Excise Act, 2016.

It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent and it is alleged that there is recovery of 40 litres of country made liquor from the petitioner but the same has not been recovered from the conscious possession of the petitioner and he was traveling in a train and under her berth the alleged recovery has been made and petitioner has no concern with the same.

Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.7982 of 2017 (2) dt.23-02-2017 2/2 for bail stating that there is recovery from the possession of the petitioner.

Having heard both sides and considering the nature of allegation, I am not inclined to grant bail to the petitioner at this stage. Petitioner may renew his prayer for bail after completion of six months in custody.

With the aforesaid observations, this application is dismissed.
