The petitioner seeks bail in Budha Colony P.S. Case No. 355/2016, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Excise (Amendment) Act, 2016.

One bottle of Royal Stag containing 750 ml. wine was recovered from the Chicken shop of the petitioner, for that the petitioner is in jail since 18.12.2016.

Learned A.P.P. opposed the prayer for bail of the petitioner and submitted that the petitioner has got criminal antecedent and he is accused in Budha Colony P.S. Case No. 256/2016 registered under Sections 272, 273 and 34 of the Indian

Patna High Court Cr.Misc. No.10959 of 2017 (2) dt.07-03-2017 Penal Code and Section 47(a) of Bihar Excise (Amendment) Act, 2016.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Patna in connection with Budha Colony P.S.
