Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 342, 376, 511/34 of the Indian Penal Code. It is alleged that petitioner and one Nirdesh Prajapati attempted to establish forceful physical relationship with the informant.

It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence under Section 376 of the Indian Penal Code is made out against the petitioner.

Considering the nature of accusation, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection with Bhorey P.S.

Patna High Court Cr.Misc. No.15853 of 2015 (2) dt.04-05-2015 2/2 Case No. 220 of 2014, pending in the Court of learned Chief Judicial Magistrate, Gopalganj.

Accordingly the application is disposed off.
