The petitioner seeks bail in Sikrahatta P.S. Case No. 84/2015 corresponding to Sessions Trial No. 160/2016, registered for the offences punishable under Section 366(A) of the Indian Penal Code.

The father of the victim made allegation that the petitioner kidnapped his minor daughter for the purpose of marriage.

During the course of investigation, the police recovered the victim. The victim made statement under Section 164 Cr.P.C. The victim deposed in the Court in Sessions Trial No. 160/2016 as witness P.W. No. 4 on 07.03.2017, but she did not support the factum of kidnapping by the petitioner. There is no tangible

Patna High Court Cr.Misc. No.21129 of 2017 (3) dt.20-06-2017 evidence to show the involvement of the petitioner in kidnapping of the victim. The petitioner is in jail since 26.12.2015.The petitioner has already remained in jail for more than one and half year.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VIth, Bhojpur at Arrah in connection with Sikrahatta P.S. Case No. 84/2015.
