JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2019 This is an application for grant of anticipatory bail in connection with Bhabua P.S. Case No. 830 of 2018, for the offences under Sections 366A/34 of IPC.

Allegation against the petitioners is of enticing the minor daughter of the informant.

Submission of the learned counsel for the petitioners is that statement under Section 164 of Cr.P.C. clearly shows that she has gone with her own sweet will and she is major. Heard learned A.P.P. also, who has stated that in her statement under Section 164 of Cr.P.C. she has made allegation against the petitioners of enticing and she is said to be the minor.

Having heard both sides, in view of the facts and

No.13719 of 2019(5) dt.04-07-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit, without being prejudiced by order of this Court.
