The petitioner has preferred this application for grant of regular bail in a case registered under sections 386, 387 and 379 of the Indian Penal Code and section 17 of the CLA Act. As per the prosecution case, while four accused managed to escape, it is stated that Siyaram Yadav and Pappu Kumar Yadav were arrested and on search, from their possession, posters and pamphlets relating to naxalites were recovered. The accused arrested disclosed the name of the four accused persons who managed to escape which included the petitioner herein.
It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any
Patna High Court CR. MISC. No.21648 of 2021(2) dt.24-09-2021 2/2 incriminating article has been recovered from his possession. The only material against him is the statement of the co-accused made before the police. He is in custody since 6.1.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation together with chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Madanpur P.S. Case no. 208 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad.
