JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner already in custody is an accused in a case registered for offence punishable under Sections 409 and 120B/34 of the Indian Penal Code. Allegation is of defalcation of Rs.4,00,000/- and odd by the bank employees of the Monghyr Jamui Central Cooperative Bank Ltd., Munger. Submission is that the petitioner was Assistant Accountant at the relevant period but had not defalcated any amount. Only Rs.5,859.58/- was found in his bank account. A departmental proceeding was also initiated on similar charge of defalcation and in the same he was exonerated as charge was not proved so permitted to rejoin. On expiry of some period, he

Having considered the said facts and circumstances, let the petitioner, namely, Vipin Bihari Shukla be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger, in connection with Kharagpur P.S. Case No.186 of 1993.
