JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of E.C. Act. The public apprehended one Md. Sajjad who was carrying kerosene oil on auto rickshaw. Md. Sajjad disclosed that he was carrying kerosene oil at the behest of the petitioner who is PDS dealer.
It is submitted by the learned counsel for the petitioner that the kerosene oil was being carried from the house of the petitioner to godown and no irregularity was found when the stock of the petitioner was inspected and a certificate to that effect has been granted by the Block Supply Officer which is Annexure 2. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.15613 of 2015 (2) dt.06-05-2015 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Araria in connection with Raniganj (R.S.) P.S. Case No.183 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
