JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act. On the complaint of consumers, the PDS shop of the petitioner was raided when the petitioner was found escaped from the scene after locking the shop. Subsequently, the lock was broken and 31 quintals of rice and 38 quintals of wheat were seized.

It is submitted by the learned counsel for the petitioner that maliciously seizure was made by the informant. It is further submitted that the PDS licence of the petitioner has already been cancelled and the said cancellation order has been challenged in writ proceeding. It is also submitted that the FIR does not

Patna High Court Cr.Misc. No.15113 of 2015 (2) dt.13-05-2015 2/2 specifically suggest any irregularity. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati, Gaya in connection with Dumariya P.S. Case No. 108 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
