The petitioners seek bail in Rupauli P.S. case No. 284 of 2016 under Section 302 and other Sections of the Indian Penal Code.

The informant alleged that while she was cooking food in her house Raman Singh, petitioner No.1, and Suman Singh came and took her husband on the pretext of some work from her house but her husband did not return. The informant further alleged that when she enquired from the petitioners they did not give any satisfactory reply. In the next morning the dead body of her husband was found. The informant alleged that petitioners and other accused persons hatched up a conspiracy and killed her

The learned counsel for the petitioners submits that there is no eye witness of the occurrence. The petitioners are on inimical term with the husband of informant from before. There is land dispute between the parties. A proceeding under Section 144 of the Cr. P. C. is also going on. It is further submitted that the mother of the deceased disclosed that her daughter-in-law informed that her husband was missing from the evening itself but she did not disclose the name of the petitioners. If appears that the informant has made specific allegation that Raman Singh and Suman Singh came and took her husband with them on the pretext of some work but thereafter Gandhi Singh, husband of the informant, did not return to his house. The informant enquired from the petitioners but the petitioners did not give any reply and in the next morning the dead body of Gandhi Singh was recovered.

Considering the facts aforesaid, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
