JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioners as well as leaned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 742 of 2014 in which cognizance has been taken under Sections-498A & 406 of the Indian Penal Code and Sections-498(A), 323, 324, 379, 149 of the Indian Penal Code and Section-3/4 of Dowry Prohibition Act.
The petitioner No. 1 is husband whereas; rest petitioners are parents-in-law of the complainant. According to complaint case itself, the complainant
Patna High Court Cr.Misc. No.11424 of 2015 (2) dt.24-03-2015 was ousted from her matrimonial home on 08-12-2009 but she filed complaint case on 25-03-2014 and there is no explanation of the aforesaid delay. Moreover, the petitioner No. 1 had already given an informatory petition in the year, 2013 and has also filed petition for restitution of his conjugal right. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 742 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, Gopalganj.
