JUSTICE RAVI RANJAN ORAL ORDER 06-04-2015 Petitioner is aggrieved by issuance of a purcha in favour of respondent no.7 under the Bihar Privileged Persons Homestead Tenancy Act (hereinafter referred to as "the Act") with respect to his Residential Plot No.1293 appertaining to Khata No.504 of an area of 4 decimals out of 44 decimals of the total land. He also seeks direction to restrain the respondent no.7 from construction of any building upon the aforesaid land. It is submitted that the land belonging to the petitioner has been settled in favour of the respondent no.7. In paragraph-17 of the writ petition, it has been stated that the
Patna High Court CWJC No.3648 of 2015 (2) dt.06-04-2015 2/2 petitioner has already moved before the District Magistrate-cumCollector, Vaishali, Hajipur under Section 21 of the Act, which is pending.
Having regard to the aforementioned facts and circumstances, this writ application is being disposed of with a direction to the Collector, Vaishali at Hajipur to dispose of Appeal No.R 133 of 2011-12 filed under Section 21 of the Act by the petitioner within a period of six weeks from the date of receipt/production of a copy of this order, if the same has already not been disposed of.
