The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 328 and 377 of the Indian Penal Code. The informant was administered some drugs and thereafter the petitioner committed unnatural offence with him.

It is submitted by learned counsel for the petitioner that the medical report neither suggests commission of unnatural offence nor administering any drug and the informant has retracted from his initial version and filed a petition to that effect before the learned court below. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the

No.12700 of 2015 (2) dt.26-03-2015 2 / 2 petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Birupur P.S. Case No. 44 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.Ist Class, Lakhisarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
